Draft on Hazardous Materials
(Management, Handling and Transboundary Movement) Rules, 2007
BACKGROUND :
After the Bhopal Tragedy, Environment (Protection) Act [E(P) Act] was
promulgated in 1986. E (P) Act is an umbrella act which covers various
environmental issues. Among a host of regulations under the E (P) Act so far
enacted, Hazardous Wastes (Management & Handling) Rules, 1989 is an
important and widely applicable regulation covering the aspects of handling,
storage, treatment, disposal and recycling of hazardous wastes (HWs). As
per the recent estimation, 8.0 million tones of hazardous waste generated
in the country. To rationalize the categorization of (HWs), major amendments
were undertaken twice in the rules in the years 2000 and 2003. Despite a number
of common and individual storage, treatment and disposal facilities (TSDFs)
that have sprung up in the past few years, the situation of hazardous waste
management is far from satisfactory. Several issues are yet to be
resolved for making hazardous waste management effective. Some of the
issues are with respect to certain categorization of wastes as per Schedules 1
and 2 of the hazardous waste regulation, import/ export of wastes, inter-state
movement of HWs, standards/ guidelines, inadequate number of TSDFs,
technology prescriptions, registration of recyclers etc.
Keeping above scenario, Ministry of Environment & Forests (MoEF), Government
of India has recently (28 September, 2007) brought out the "Draft
on Hazardous Materials (Management, Handling and Transboundary Movement) Rules,
2007" in supersession of the existing Hazardous
Wastes (Management and Handling) Rules 1989. Said draft rules will be taken
into consideration by the Central Government after expiry of a period of sixty
days from the date of publication of this notification in the Official Gazette.
It may be noted that MoEF is now inviting objections and suggestions with
respect to the said draft rules from concerned stakeholders and general public.
Thus the aim of this Discussion Forum is to build awareness, discuss issues of
concerns, and it will also help CII to take a consolidated views of industry on
the proposed Draft Rule to the Ministry of Environment & Forests before the
dead line of 60 days. Kindly go through the Draft Rules and
send your concerns/suggestions as early possible.
